Terms of Service

1. Acceptance

By using aplexica.com, the Aplexica daemon, or any service operated by us, you accept these Terms. If you do not accept them, do not use the service.

2. The Open Source edition

The Aplexica daemon is licensed under the GNU Affero General Public License v3.0 (“AGPL-3.0”). Your use of the daemon is governed by that license, not by these Terms. The Open Source edition is provided AS-IS without warranty of any kind.

3. Aplexica Cloud

If you create an account on Aplexica Cloud, the following additional terms apply.

3.1 Account

You must be at least 16 years old to create an account. You are responsible for keeping your credentials confidential and for activity under your account.

3.2 Plans and billing

Paid plans are billed monthly or annually in advance. Fees are non-refundable unless required by law. You can cancel at any time; service continues through the end of the paid period.

3.3 Acceptable use

Don’t use Aplexica to do things that are illegal, harmful, or disruptive. Don’t try to reverse the cloud cryptography (we built it to be uninvertible; you’d be wasting your time). Don’t redistribute the service or rebrand it.

3.4 Service availability

We aim for high availability but the Open Source edition and free Cloud features come with no guaranteed uptime. Paid Cloud tiers come with the SLA published on the pricing page; Enterprise SLA is in the order form.

4. Intellectual property

You retain all rights to the content you store in Aplexica. We retain all rights to the Aplexica software, brand, and documentation other than what the AGPL grants you for the daemon.

5. Privacy

How we handle your personal information is described in the Privacy Policy. The Privacy Policy is incorporated into these Terms by reference.

6. Disclaimer of warranties

To the maximum extent permitted by law, Aplexica is provided “AS IS” without warranties of any kind, express or implied.

7. Limitation of liability

To the maximum extent permitted by law, Aplexica is not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data or profits. Our total liability for any claim is capped at the amount you paid us in the twelve months preceding the event giving rise to the claim, or US$100, whichever is greater.

8. Termination

You can stop using Aplexica at any time. We can suspend or terminate your account if you violate these Terms or for prolonged inactivity. We will give reasonable notice except for safety, legal, or abuse reasons.

9. Changes

We may update these Terms; the effective date above reflects the most recent change. Material changes are announced on the blog 30 days in advance.

10. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms shall be resolved exclusively in the courts of the Province of Ontario sitting in the City of Toronto.
